The Delhi High Court has issued an interim order restraining Tesla Power India from advertising or promoting its products under the “Tesla” brand name, following a trademark dispute initiated by Tesla Inc., the U.S.-based electric vehicle giant led by Elon Musk. The ruling aims to prevent consumer confusion and protect the global brand’s trademark rights in India.
Court Restricts Tesla Power From Using ‘Tesla’ Trademark
According to the order, Tesla Power India is prohibited from using the “Tesla” name, logo, or any mark visually or phonetically similar to Tesla Inc.’s registered trademarks across all advertising platforms.
This restriction applies to:
-
Vehicle batteries
-
Inverters and automotive UPS systems
-
Lead-acid and VRLA batteries
-
Lithium-ion battery products
-
EV-related offerings promoted under the Tesla Power branding
The court emphasized that promoting such products using the Tesla name risks misleading consumers due to the strong global association of the brand with electric vehicles.
Trademark Dispute Intensifies Amid Brand Confusion Concerns
Tesla Inc. argued that Tesla Power India’s branding and marketing practices have caused customer confusion, with some consumers reportedly mistaking its products as being associated with the American EV maker.
The court noted that Tesla Power had previously given an undertaking stating it had no intention of entering the EV manufacturing sector, further raising concerns about the scope of its current branding activities.
Earlier hearings also saw the court seeking disclosure from Tesla Power India regarding its EV-related business activities, product lines, and dealer network to assess potential infringement.
Mediation Efforts Fail, Legal Battle Continues
Both companies had attempted mediation earlier, but discussions failed to resolve the dispute. With the interim order now in effect, Tesla Power India will be unable to issue advertisements or promotional content using the disputed brand name until the case concludes.
The court’s decision offers temporary relief to Tesla Inc., safeguarding its intellectual property as it prepares to expand its footprint in India’s fast-growing EV ecosystem.
What Comes Next for Tesla Power India
The company must now modify its marketing, packaging, online presence, and retail branding to comply with the court’s restrictions. The interim order sets a precedent for stricter enforcement of trademark protections within India’s energy-storage and EV sectors.
The trademark case will continue in the Delhi High Court, where the final verdict will determine the extent of Tesla Power India’s future rights to use its existing brand identity.
